Peter Schwingler, partner at Jones Day, is a nationally recognized antitrust lawyer and class action litigator. He is continuing the antitrust career he began at the Department of Justice. He has served as lead counsel in several high-profile antitrust matters, including an FTC “second request” investigation, a collection of class action and individual antitrust lawsuits against the pork industry, and a monopolization case against a health care provider.

“Antitrust law gives something for everyone, and is bipartisan or nonpartisan,” Schwingler told Minnesota Lawyer in 2024. It is a foundational legal principle that establishes free markets.

What are the biggest challenges you currently see in business litigation?

The two biggest challenges are the escalating cost of discovery and overburdened courts.

Without revealing the names of a client, what is the most interesting case you’ve worked on lately?

I’ve been fortunate to work on a number of interesting antitrust matters, including government investigations and putative class actions in health care, education, and agriculture. Most of these cases involve novel antitrust theories related to algorithmic pricing, the alleged exchange of sensitive information, or product design.

How do you manage work/life balance?

I try to maintain a daily routine that involves family time and exercise.

What is one thing you would change about Minnesota if you could?

I would like to see more restaurants and stores that are walkable from residential areas. Put another way, we need more neighborhoods that have small “downtowns,” like Linden Hills in south Minneapolis.

What’s something most people don’t know about you?

I have a minor obsession with barbecue. In 2025, I’ve been focused on pork shoulder and beef short ribs.
