Appellant challenged the District Court’s dismissal of her medical-malpractice claims against respondents, doctor and medical facilities. Appellant argued that the District Court erred by deciding that appellant’s affidavits of expert review and expert disclosure were insufficient. The District Court determined that the amended disclosure affidavit was untimely because it was not served within 180 days of the start of the lawsuit. Appellant asserted that serving and filing the amended disclosure affidavit one day before the motion hearing was timely under the safe-harbor provision. The Court of Appeals held that the District Court acted within its discretion in dismissing the case. Affirmed.
