Construction Law – Indemnity Agreement

Where the employee of a sub-subcontractor was injured on the job site; and the sub-subcontractor and subcontractor had executed a standard subcontract agreement, which provided that the sub-subcontractor would indemnify the subcontractor for claims for which the subcontractor may be or is claimed to be liable and required the subcontractor to purchase insurance sufficient to cover the indemnification obligation; we conclude that the District Court did not err by enforcing the indemnification provision because a construction agreement is enforceable if a subcontractor agrees both to indemnify for another’s negligence and to insure that risk.

In addition, the District Court did not err in awarding attorney fees. Affirmed. Motion denied.
