Arising Out Of

Employer and insurer appealed from the compensation judge’s finding that employee suffered a compensable injury.  Employee cross-appealed the compensation judge’s average weekly wage (AWW) determination and the denial of his claims for penalties.  The Court of Appeals held that, where employee regularly traveled for work and, at the time of the injury was on the same route he would have taken had he been traveling from his home to the work site, substantial evidence supported the compensation judge’s determination that the location of the employee’s injury was in the area of the employer’s business and therefore occurred in the course of his employment. Affirmed as modified.
