Appellant challenged his convictions of first-degree assault, second-degree assault, and unlawful possession of a firearm, arguing, inter alia, the evidence was insufficient to support his conviction of first-degree assault because the victim did not suffer great bodily harm. The Court of Appeals held that whether an intrusive gunshot wound creates “a high probability of death” under Minn. Stat. § 609.02, subd. 8, is determined at the time it is known what path the bullet took and what parts of the body were hit. Affirmed in part, reversed in part, and remanded.
