In this case involving a conviction of first-degree controlled-substance crime as a subsequent controlled-substance offense, appellant state argued that the District Court abused its discretion by failing to sentence respondent to an executed term of imprisonment of at least 48 months. The Court of Appeals concluded that the District Court abused its discretion by sentencing respondent without regard to the mandatory minimum. Reversed and remanded.
