Where an immigrant from Kenya who overstayed his student visa argued that he was denied a merits hearing on a false representation charge, the petitioner did not ask for a hearing or complain that he did not receive one, so he forfeited his right to a hearing and his due process, statutory and regulatory violation arguments thus failed, and substantial evidence supported the false-representation finding. Petition denied.
