Insurance Fire Loss Insurance Application Misrepresentation

Where a district court found in a fire loss case that a homeowner’s policy was void due to a misrepresentation on the application, the district court properly granted summary judgment to the insurer on the homeowner’s claim of bad faith and the insurer’s defense of arson claim, but summary judgment for the insurer is reversed on the alleged misrepresentation in the application and on the homeowner’s breach of contract claim. Judgment is affirmed in part; reversed in part; remanded.
