Negligence – Hospital Lien; Interference; Settlement Proceeds

 

 

Where a medical center sought damages for the impairment of its hospital lien after the plaintiff in an auto accident, wrongful death case accepted settlement from the tortfeasor and his insurer, the medical center argued that the tortfeasor and the insurer impaired the lien, and the district court erred in construing the complaint as an action to enforce the lien rather than a statutory action for damages based on the impairment of the lien, so the court’s orders are vacated and the case is remanded for further proceedings. Vacated; remanded.
