Where a bank and its subsidiary brought claims including fraud and promissory estoppel in a dispute over oil and gas leases with energy and operating companies and their officer, and the bank challenged the dismissal of its claims as well as a judgment against it for the misappropriation of trade secrets, damages, prejudgment interest and attorney’s fees, the defendants were not contractually obligated to preserve leases as collateral, so the leases could not serve as collateral under the contract, and the judgment is affirmed because there was no showing that the district court’s calculation of damages was clearly erroneous and the court also did not err in concluding that the bank’s misappropriation was willful and malicious under North Dakota law to support the award of attorney’s fees. Judgment is affirmed.
