The Fargo-Moorhead Diversion Authority is appealing a judge’s order to stop construction on a levee south of Fargo until an environmental review is completed.
U.S. District Judge John Tunheim of Minnesota issued the order last week after opponents of a Red River diversion argued that the dike should not be built until the Minnesota Department of Natural Resources completes its study.
A group representing about 20 cities and townships in North Dakota and Minnesota filed a lawsuit in August 2013 against the diversion and added a motion to stop construction of the dike.
