Tort – Defamation; Falsity

 

Where a plaintiff brought a defamation claim against union defendants arising from a fact-finding meeting about a workplace dispute, the allegedly defamatory statements were made in front of company and union representatives, concerned the plaintiff’s profession and were not privileged, and the plaintiff also showed that a genuine issue existed as to the element of falsity, so the elements of a defamation claim were satisfied and the grant of summary judgment to the defendants is reversed and remanded. Judgment reversed, remanded.
