Deeds Of Trust – Defective Acknowledgement; Nebraska Law

Where the bankruptcy court declared that a bank’s deeds of trust on a debtor’s real property were void as they were not properly acknowledged and recorded under Nebraska law, the judgment is reversed because the recorded notices of default would provide a bona fide purchaser with notice that the bank was claiming some interest in the property, regardless of whether the recorded deeds met all filing requirements. Judgment is reversed.
