A local attorney is facing charges that she misappropriated funds from her law firm's trust acount to cover the firm's payroll and employer withholding expenses.

Suspension sought over trust account violations

The Office of Lawyers Professional Responsibility has filed a petition with the Minnesota Supreme Court seeking to suspend Minneapolis attorney Jo Fairbairn for wrongdoing with respect to her law firm’s trust account.

The office alleges that Fairbairn, as treasurer of the law firm of Kinney & Lange, violated Rule 1.15(a) by allowing shortages to exist in the firm’s trust account, which caused the inadvertent misappropriation of client funds. The office also contends that in violation of Rule 8.4(c), Fairbairn intentionally misappropriated client funds from the firm’s trust account to cover payroll and employer withholding obligations.

Fairbairn has 20 days to respond to the allegations.
