Open Letter: Dear Senator Limmer This bill is a battle between Conscious and Self-Interest. Is it and any wonder why Senator Newman and Senator Thompson, Representative Smith, Senator Latz and Representative Bobby Joe Champion may oppose this legislation. The Fiscal note was contrived with only the debit side of the balance sheet without considering the credit side of the balance sheet. Whom was responsible for the Fiscal Note? The Judiciary. We are asking the Fox to guard the little hen house and telling the Fox not to nimble. How insane! Everyone agrees it is best to have two parents in a child’s life. The National average is 90%/10% of physical custody after a divorce. Give a voice to the children and stop the hypocrisy, when individuals are really only concern about their pocket book. Please Do what is best for the Children!!! As parents we sacrifice for our children. The greatest sacrifice is to give your life for another. Allow a parent to do best by their children. The children just want to be know and Love by their parents!!!

Dear All please listen to the Senate Judiciary committe meeting on March 21 The opposition in the State Senate Judiciary Committee suggested bill 1402 were more about decreasing child support than having increased physical custody of the child. To alleviate this concern Senator Pam Wolf said she would delete the portion of the amendment to change the child support parenting time adjustment, but decouple it from the physical custody and increase the actual physical custody to 55/45% from the current 75/25% presumption. The opposing side would not accept this even though it would mean that dads would continue to pay 88% of the child support even when they could get only 40% of the parenting time with their children. A presumption of equality will reduce conflict and litigation for parents, thereby reducing the amount of money parents need to pay in attorney expenses which is now required to litigate for equal physical custody, because the current statute disfavors equal involvement of each parent. What occurred to many citizens in the audience observing this hearing at this point was that the opposing side does not care about the Mother/Father or the children. The opposition seemed more concerned about maintaining a legal stream of revenue than advantaging the child by increasing the presence of the father in the child's life. Moreover, in a shockingly cynical maneuver, by refusing to accept the proposed amendment to the bill, the opposition was then able to use the reduction in child support to try defeat the bill.

In Reference to the cost in which I believe the state would actually save 10Million a year. I propose this argument: The argument I would make (I am an amateur) is that you cannot claim that remediation of a prior injustice is a cost which should be avoided. The law is an effort to correct an important injustice in the existing law. I would say that \the existing law has created clear and documented injustices ... there are always costs to overcome past injustices, such costs are an essential element of our society and its social fabric. Such costs should never be an impediment to achieve justice for the harmed. The members of society who are harmed by the current law include not only many fathers but most importantly many children as well. These are injustices which should be corrected and yes there is a cost to correct a prior injustice. Finally, we completely dispute that any incremental costs are incurred for new situations. The proposed law change solely changes the basis on which judges should evaluate the case.\

Fraudulent documents are being submitted all over the U.S. by Attorneys, who should be criminally prosecuted ! Wells Fargo Bank, N.A. is by far the KING of FRAUD in this country with Bank of America by its side in second. The citizens of this country need to really take it to the Federal Government in huge protests with huge numbers of people turning out. Hunt Leibert Jacobson P.C. attorneys at law (crooks violating law) is one law firm to really watch out for. Wells Fargo Bank, N.A. was just denied summary judgment against us (for liability) Lets get it on. Sign Me Up !

Justice Meyer has been an excellent addition to the court. It is unfortunate for Minnesota that she is leaving.

As a small business owner who has been in Minnesota's conciliation court system (several times), I know it doesn't provide any \resolution\ - it just charges a fee for a judgement.

The judge requests the involved parties to go discuss the issue and come back if an agreement can't be reached. Well, why are we in court to begin with? Obviously an agreement couldn't be reached prior to court because nobody likes to have to take time off work and then be told, by those we paid a fee, to try to reach an agreement by ourselves.

The result is an \official judgement\.
Good luck trying to collect:
File a lien - another fee and wait for nothing.
Try to seize money from the debtors bank account - another fee and first you have to find the account and then advance notice must be given (so that they have time to empty the account?)
Try to seize assets - another fee and more exemptions of assets that can't be touched that can.

Conciliation court only benefits those with jobs within the court system. It's of no benefit to those paying a fee and expecting a \resolution\.
Conciliation court is a joke!

Maybe you should check out the Audit done by the inspector general on Wells Fargo..
http://www.hudoig.gov/Audit_Reports/2012-AT-1801.pdf

There was ALOT of fraud that has happened in this whole mess. Can't comment on this case but chances are there was some wrong doing by some one. As to Some of the comments.. yes they took out a mortgage yes they need to pay it back.. but should they really have to pay for the inflated mortgage that was given to them so the banks could make more profit... Taking the price of a $150,000.00 home and claiming it was worth $350,000.00 was FRAUD and most of the people that I know just want to pay what is fair... The bank's were the ones that started all this and they need to restructure the mortgages to reflect the fair market value of the homes. No one should get their house for free but we should not have to pay for the fraud that we were put through...
