    Right now the judges and foreclosing attorneys in Cook County are side stepping the law and denying the consumer due process by special standing orders that avoid the requirement of a sheriff to serve process prior to a court appointed process server that is registered with the state. This order also comes from the municipal department not the chancery department. There is no application in chancery to allow a 3 month pass that allows attorneys to hire detective agencies to serve process without having to re-motion the court every time. It has also been discovered that the affidavits have been stamped by people who claim to be a notary and are not registered with the state. There are statutes that are clear on service and this practice had been questioned and everyone gets upset. Although there are some that say, keep doing this it is opening up a can of worms. Some that know what is happening yet for fear of losing their jobs remain silent.
