Judicial modesty! Judicial activism! (access required)

In a 5–4 decision engineered by Chief Justice Roberts, the Supreme Court on June 28 held that the Affordable Care Act’s individual-health-insurance mandate is constitutional as a tax. I’ll summarize how the Court reached its decision, and then give three takeaways from it.
