ABA goes on record to repeal DOMA

The American Bar Association has gone on record in support of the repeal of the Defense of Marriage Act, the law that denies federal benefits for same sex couples married in states that allow for gay marriages.

Earlier this year President Obama announced that his administration would no longer defend the law because he views it as unconstitutional.

In a letter to the senate judiciary committee, an ABA representative said the group wants the Defense of Marriage Act repealed and a new law adopted that “makes clear that state-sanctioned gay marriages must be recognized by the federal government.”

“After many years of legal confusion and complications created by DOMA, the Respect for Marriage Act would provide a much-needed level of clarity that would allow lawyers to better serve their clients and communities,” the letter states.

  1. ANY TWO PEOPLE THAT LOVE EACH OTHER. SHOULD BE ALLOWED TO MARRY. THIS IS SUPPOSE TO BE THE LAND OF THE FREE BUT THE NATIVE AMERICAN’S ARE STILL ON RESERVATIONS. THE GAY PEOPLE SHOULD BE FREE TO MARRY WHO THEY LOVE AS MUCH AS THE NATIVE AMERICANS SHOULD HAVE MOTHER EARTH BACK. THEY KNOW HOW TO TAKE CARE OF HER. THE GAY PEOPLE KNOW HOW TO BE A TRIBE ALSO. WE HARM NONE. IF YOUR STRAIGHT GOOD FOR YOU BUT IT AS ALSO O.K. TO BE GAY,RED,YELLOW,BLACK AND MIXED! WE ALL BELONG TO EACH OTHER. LETS ALL TRY TO STAND WITH PRIDE.

  2. I would have thought that the ABA could think more clearly. States are always free to give their citizens greater rights than are afforded under the Constitution. But, to claim that the federal government must honor a state’s “right to marriage” law would force the federal government to honor 50 different laws when interpreting federal statute.

  3. David – the Feds already have to manage separate marriage laws for 50 states, DC, and the territories. Your argument is completely bogus.
